第九条 is a federal law that protects people from 性 discrimination in educational programs and activities at colleges and universities that receive federal financial assistance. 性骚扰, including 性ual violence, and retaliation are forms of discrimination prohibited by 第九条. The law reads, in part, as follows:

No person in the United States shall, on the basis of 性, be excluded from participation in, be denied the benefits of, or be subject to discrimination under any educational program or activity receiving Federal financial assistance.

What constitutes 性ual harassing behavior?

性骚扰 is unwelcomed, 性别-based verbal or physical behavior that is objectively offensive and is severe, 持续的, 或无处不在. The effect of harassment creates a hostile environment and/or interferes with, 否认, or limits a person’s ability to benefit from Concordia’s educational programs and/or activities. University Non-Discrimination Statement

Concordia University (CU) fully subscribes to all federal and 状态 civil rights laws banning discrimination in private, church affiliated institutions of higher education, subject to the First Amendment. CU will not illegally discriminate against any employee, applicant for employment, student or applicant on the basis of race, color, 性, 怀孕, national origin (including ancestry), 国籍, physical or mental disability, 年龄, 婚姻状况, 性别, veteran or military status, predisposing genetic characteristics, domestic violence victim status, or any other protected category under applicable local, 状态 or federal law. 然而, CU is a Christian educational institution operated by The Lutheran Church-Missouri Synod and, in compliance with Title VII of the Civil Rights Act of 1964, reserves the right to give preference in employment based on religion.

Gender discrimination and 性ual harassment (including 性ual assault) are prohibited by Title VII of the Civil Rights Act of 1964 as amended and 第九条 of the Education Amendments of 1972.

Biblical Perspective and the Statement of Purpose for 第九条 Program

Biblical Perspective: The University accepts the 圣经s as the inspired and inerrant Word of God, and is compelled by the 圣经s to be faithful to the religious tenets articulated therein. These religious tenets are set forth in the Constitution of the Lutheran Church Missouri Synod and illuminated by the Lutheran Confessions, a true and binding exposition of Holy 圣经. To the extent that these tenets permit, the University remains committed to complying with the spirit and letter of federal, 状态, and local laws affording equal educational opportunity and nondiscrimination in admission to and participation in the University’s programs and activities. 然而, 在某些情况下, 圣经, as understood by the Church and the University, requires the institution to act in ways that may conflict with certain of the regulations implementing 第九条, as interpreted by the OCR and other 状态 and local laws.
